NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The “Sun Smart Quiz” Sweepstakes (“Sweepstakes”) begins at 12:00:01 a.m. (“Sweepstakes Start Date”), Eastern Daylight Time (“EDT”) on July 29, 2010 and ends at 11:59:59 p.m. EDT, on August 29, 2010 ("Sweepstakes Period"). The Sweepstakes is sponsored by OMP Inc., 3760 Kilroy Airport Way, Ste 500, Long Beach, CA 90806 (the "Sponsor"), who is solely responsible for all aspects of this Sweepstakes.
Eligibility: Sweepstakes is open to all legal residents of the United States and District of Columbia who are 18 years of age or older as of the Sweepstakes Start Date. By entering this Sweepstakes, participants agree to these Official Rules and to the decisions of the Sponsor, which are final and binding in all respects. This offer is void where prohibited by law, and subject to all applicable federal, state, and local laws and regulations. Employees, officers, and directors (including immediate family members and members of the same household) of the Sponsor (“Sweepstakes Entities”), its divisions, parent company, subsidiaries, affiliates, advertising and promotion agencies, prize suppliers, and any other entities directly associated with this Sweepstakes are not eligible to participate. All federal, state and local laws and regulations apply. Void where prohibited.
How to Enter: During the Sweepstakes Period, eligible entrant must complete the online registration form and the short Sun Smart Quiz available at http://www.obagi.com/consumer/innercircle/enroll.aspx (the “Website”). Each entrant will be required to provide name, date of birth, complete mailing address (including city, state, and zip code), telephone number and email address. Upon submission of the completed registration form and quiz, each entrant will receive one (1) valid Sweepstakes entry. All entries must be received by 11:59 p.m. EDT on August 29, 2010. Limit one entry person per mailing address and/or email address. All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of an entry. Internet entries must be made by the entrant only at the Website. Entries made by any other individual or any entity, and/or originating at any other website or email address, including, but not limited to, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of automated entry devices is prohibited and no mechanically reproduced entries are allowed; all such entries are void. Sweepstakes Entities are not responsible for: lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, or misdirected entries. Sponsor reserves the right to disqualify any person or email address that submits more than the maximum allowed entries by using multiple/different email addresses, identities, registrations and logins, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Sweepstakes. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. By participating, you consent for Sponsor to obtain, use, and transfer your name, address and other information for the sole purpose of administering this Sweepstakes.

Internet Limitations of Liability: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice, or to disqualify any individual who tampers or attempts to tamper with the entry process, and thereafter, award the Prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be determined as the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsors are not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email account to receive email messages. Sponsors are not responsible, and may disqualify an entrant, if the entrant’s email address does not work or if it is changed without prior written notice to Sponsor.
Prizes: Following the conclusion of the Sweepstakes, twenty-five (25) Grand Prize winners will each receive Professional-C Serums™. Each Grand Prize package has an Approximate Retail Value (“ARV”) of $95. All local, state and federal taxes are the sole responsibility of winner. By accepting the Grand Prize, each prize winner agrees to release the Sponsor and the Released Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded. No substitution or transfer of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value in the event that any aforementioned prize is not available. All decisions by Sweepstakes Administrator as to prize winners and prizes are final. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.
Prize Conditions: All taxes, if applicable, are the sole responsibility of each Grand Prize winner. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for the prize at issue. The winner’s entry, and acceptance of the prize, constitutes permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, throughout the world, and without notice, review, approval, or further compensation. Winner waives any right to inspect or approve any such use.
Terms & Conditions: This Sweepstakes is subject to all applicable federal, state, and local regulations and laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator and Sponsor, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Sponsor, Sweepstakes Administrator, vendors associated with the Sweepstakes, and the respective officers and employees of these entities, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this Sweepstakes to the fullest extent permitted by law. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law. This Sweepstakes is void where prohibited. Entrants acknowledge that Sponsor and its agents have not made any representation, warranty or guaranty, in whole or in part, in law or in fact, relative to the prize.
Drawing and Notification: All prize winners will be selected, from among all eligible entries received, in a random drawing on or about September 8, 2010, by American Sweepstakes & Promotion Co. (“the Sweepstakes Administrator”), an independent judging organization. Odds of winning will depend on the total number of eligible entries received.
