Eligibility

Obagi Medical Products, Inc. (or “Sponsor”) Season of Giving Pinterest Campaign is open to everyone except for individuals who are or were employees of Sponsor or its affiliates, manufacturers, sales representatives, subsidiaries, or parent companies, advertising/sales promotion agencies, or judging organizations since January 1, 2012. Void where prohibited. Entry materials become the property of Sponsor and will not be acknowledged or returned.

Entry

The Campaign will begin at 12:01 am EST on December 3, 2012, and all entries must be received by 11:59 pm EST on December 27, 2012. The following rules apply to each submission:

  • Log in to Pinterest or sign up for free here: https://pinterest.com/join/signup/.
  • Visit the Obagi Season of Giving Pinterest board: http://pinterest.com/obagi/obagi-season-of-giving/.
  • Repin any of the images found on the Season of Giving pinboard.
  • Each pin’s caption must include the words “#SeasonOfGiving”.
  • Obagi will donate $10, up to a maximum of $15,000, to the American Cancer Society Making Strides Against Breast Cancer for each repin.
  • The Campaign will close at 11:59 pm EST on December 27, 2012. Repins after the Campaign has closed will not be included in the final donation amount.

Sponsor will not be responsible for incomplete, lost, late, post-due, misdirected, copied, transferred, or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware, or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the Pinterest account from which they were sent. For these purposes, a Pinterest account holder shall mean the natural person assigned to such account by the provider associated with the Pinterest account. You acknowledge that in posting your repins they will be freely accessible to the public and you grant Sponsor the right to display them. Any questions regarding the number of entries submitted or the owner of the Pinterest account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Campaign.

Donation

Final donation amount will be announced on or about December 29, 2012, from among all eligible entries received by December 27, 2012. By participating, entrants agree to be bound by these Rules and Regulations and by the decisions of the Sponsor, which shall be final and binding in all respects.

Participation

By participating, entrants agree to be bound by these Rules and Regulations and by the decisions of the Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Campaign as solely determined by Sponsor. In the event the Campaign is compromised by a virus, nonauthorized human intervention, tampering, or other causes beyond the reasonable control of Sponsor that corrupts or impairs the administration, security, fairness, or proper operation of the Campaign, Sponsor reserves the right in its sole discretion to suspend, modify, or terminate the Campaign. Should the Campaign be terminated prior to the stated expiration date, Sponsor reserves the right to award a donation based on the entries received before the termination date.

Conditions

All federal, state, and local laws apply. Void where prohibited. By agreeing to participate in the Campaign, each participant is bound by these Rules and Regulations. Any decisions related to the campaign, the Rules and Regulations, the operation of the Campaign, and the qualifications and eligibility of any participant are at the sole discretion of Sponsor and are final. Each participant agrees to release and hold Sponsor, its employees, officers, directors, shareholders, agents, representatives, and its subsidiaries, parent companies, or other affiliated companies harmless from any and all damages, losses, claims, and liabilities arising out of his or her participation in the Campaign. Sponsor reserves the right, in its sole discretion, to terminate, suspend, or otherwise cancel the Campaign at any time for any reason.

Sponsor is not responsible for any (i) lost, late, damaged, misdirected, or illegible entries or any miscommunications, (ii) unavailable or failed networks, servers, telephones, or other connections, or any interrupted, misrouted, or scrambled transmissions, (iii) failure of the website, computer equipment, or software, (iv) congestion on the Internet, or (v) other errors or problems of any kind whether mechanical, human, electronic, or otherwise. Any attempt to deliberately damage the website or to undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including, without limitation, criminal prosecution.
